B.C. Reg. 64/2016, deposited March 2, 2016, under the MOTOR VEHICLE ACT [section 209]. Order in Council 140/2016, approved and ordered March 1, 2016.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended as set out in the attached Appendix.

Appendix

1 Schedule 1 to Division 23 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended by striking out the following:

Motorcycles OK

2 Section 42.01 is amended

(a) by adding the following definition:

“electric motor vehicle” means a motor vehicle that

(a) has an electric propulsion engine and a battery storage system that can be charged from an external electric charging outlet, and

(b) displays a permit, in a form issued by the minister responsible for the administration of the Transportation Act, on the vehicle’s rear bumper or rear window; , and

(b) by repealing the definition of “freeway”.

3 Section 42.02 is amended

(a) in subsections (1) and (2) by striking out “on a highway other than a freeway”,

(b) in subsection (2) (c) by striking out “vehicle lane” and substituting “lane”,

(c) in subsection (3) (a) by striking out “on the laned roadway” and substituting “on the highway”, and

(d) in subsections (3) (d) and (4) by striking out “motor cycle, taxi or handy dart vehicle” and substituting “motorcycle, taxi, handy dart vehicle or an electric motor vehicle”.

4 Section 42.03 is repealed.
